These Terms of Service govern your use of the Pink Hoodie website and your purchase of products or services from Pink Hoodie. Pink Hoodie is owned and operated by Love, Eden Ashley DBA Pink Hoodie. By accessing this website, submitting an order, or purchasing from us, you agree to these Terms.
Online store terms
You must be legally capable of entering into a binding agreement to make a purchase. You may not use our products, services, or website for unlawful or unauthorized purposes.
You agree to provide current, complete, and accurate purchase, billing, shipping, and contact information. You are responsible for reviewing product details, sizes, colors, customization information, shipping addresses, and order quantities before completing checkout.
Products and availability
We make reasonable efforts to display our products accurately. Colors and details may appear differently depending on screen settings, lighting, garment-dye processes, and manufacturing variations.
Measurements and size charts are approximate. Apparel sizing may vary by brand, style, color, and production batch. Customers are responsible for reviewing available sizing information before ordering.
Products may be limited in quantity and may be modified or discontinued without notice. We do not guarantee that every item, color, size, or design will remain available.
Made-to-order merchandise
Many Pink Hoodie products are produced after an order is placed. Unless a product listing states otherwise, please allow 3–9 business days for production before shipment. Weekends and federal holidays are not business days.
Ready-to-ship, preorder, custom, personalized, and rush products may have different timelines stated in their product descriptions. When an order contains products with different timelines, the order may ship together according to the longest applicable timeline unless Pink Hoodie agrees to split the shipment.
Orders and payment
Prices are listed in U.S. dollars and may change without notice. Applicable taxes and shipping charges are calculated during checkout.
Submission of an order does not guarantee acceptance. Pink Hoodie may refuse, limit, or cancel an order because of inventory or pricing errors, suspected fraud, product limitations, or an inability to fulfill the order. If we cancel a paid order, we will refund the canceled amount.
Discounts cannot be combined unless expressly permitted. Discounts have no cash value and cannot be applied retroactively.
Custom and personalized orders
Customers are responsible for submitting accurate names, dates, numbers, spelling, colors, sizes, artwork, and other customization details.
Pink Hoodie is not responsible for errors approved by the customer or included in customer-submitted information. Custom and personalized merchandise may enter production immediately and is final sale except when Pink Hoodie produces an item differently from the approved specifications.
Customers represent that they have permission to use any artwork, logos, photographs, trademarks, names, or other materials submitted to Pink Hoodie. Customers may not request products that infringe another party’s rights.
Returns, cancellations, and shipping
Returns, refunds, cancellations, fulfillment, delivery, and pickup are governed by our Return and Refund Policy and Shipping Policy, which are incorporated into these Terms.
Intellectual property
Unless otherwise stated, this website and its contents—including Pink Hoodie branding, original designs, graphics, photographs, product descriptions, text, and other creative materials—are owned by or licensed to Pink Hoodie.
No content may be copied, reproduced, altered, distributed, resold, or used commercially without prior written permission. Purchasing a product does not transfer ownership of the underlying artwork or intellectual property.
Customer content
If you tag Pink Hoodie, submit a review, or voluntarily send us photographs or content, you retain ownership of your content. We will request permission before using identifiable customer photographs in unrelated paid advertising. Reviews and content intentionally submitted through store review or community features may be displayed in connection with Pink Hoodie and its products.
Prohibited conduct
You may not interfere with the website, introduce malicious code, attempt unauthorized access, scrape store content, impersonate another person, submit fraudulent information, or use the website in violation of applicable law.
Third-party services
Our store is hosted by Shopify and may use third-party payment, shipping, analytics, and technology providers. Pink Hoodie is not responsible for third-party websites or services outside our reasonable control. Your use of those services may be governed by additional terms.
Disclaimer
To the fullest extent permitted by law, products and website services are provided without warranties beyond those expressly stated. Nothing in these Terms excludes rights or remedies that cannot legally be waived.
Limitation of liability
To the fullest extent permitted by law, Pink Hoodie and its owner will not be liable for indirect, incidental, special, or consequential damages arising from website use, delivery interruptions, or product use. Pink Hoodie’s total liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim.
Severability
If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.
Governing law
These Terms are governed by the laws of the State of South Dakota and applicable federal law, without regard to conflict-of-law principles.
Changes
We may update these Terms by posting a revised version to this website. Changes apply prospectively from the posted effective date.
